If it happens on campus, it is the school's responsibility. Period. This includes extra-curricular activities and school sponsored events ocurring at the school. If it happens off campus at a chaperoned, school-sponsored event, the school is responsible for the student's safety and welfare from the time the student is checked in until the student is checked out to a parent/guardian/or parent-approved form of transportation home. If it happens off-campus between the school and home (unless it's on a school bus, where the school retains responsibility until the student is clear of the bus stop), then the school has no responsibility.
From information in this article, it is clear that the girl was raped and beaten on campus. That means the school bears some responsibility for the girl's safety and the breach of that safety. They were negligent in checking the property - and how could they not hear this? If that many people were involved in the rape and beating, it was not done quietly. And why were they not policing for drunks? This is a high school, the chaperones were responsible for making sure no drunks got near the students and no students were drinking alcohol.
It boggles my mind that any school at all could deny responsibility for injuries done to students on campus. By disclaiming responsibility, they are telling rapists and would-be rapists that it's OK to rape students on school grounds.
